Les nouveaux espaces publics et l’hygiène publique, une mise en ordre de la rue (1883-1889) Conclusion Résumé Durant la deuxième moitié du XIXe siècle l’espace urbain de Tunis est en proie à de nombreux problèmes de salubrité et d’hygiène et en même temps fait il l’objet de volontés de renouvellement. Le conseil municipal (1858), puis le conseil d’hygiène et de salubrité publique (1873) édictent des règlements basés sur la notion d’intérêt général et d’utilité publique qu’ils auront des difficultés à appliquer. Il faudra deux décennies pour que la propreté et l’hygiène, affaire privée, du ressort des habitants, passent sous le contrôle de l’institution municipale. Avec le protectorat, un arsenal règlementaire nouveau est mis en place. Au plan urbain le règlement de voirie de février 1889 et le règlement sanitaire de 1903 achèvent de donner corps à une nouvelle vision de l’espace urbain, assaini, ordonné, aligné, ouvert, salubre. Cette règlementation a coexisté avec des pratiques juridiques et des usages antérieurs jusqu’à la fin du XIXe siècle. Ce n’est qu’à l’aube du XXe siècle que les anciens usages battus en brèche disparaîtront au profit des nouvelles règles et pratiques de promotion de la voie publique. L’année 1914 marque un tournant dans la gestion urbaine et l’expansion de la capitale. Elle signe aussi la relégation de la ville ancienne au statut de « quartier » de la ville et la primauté de la « ville européenne ». Abstract Cleanliness, hygiene and public space in Tunis through uses and regulations, 1858-1914. During the second half of the 19th century, the urban space of Tunis was plagued by many health and hygiene problems and at the same time was the subject of renewal wills. The City council (1858), then the council of hygiene and public health (1873) enacted regulations based on the concept of general interest and public utility which they had difficulty to apply. It will take two decades for cleanliness and hygiene, previously a private matter which was the responsibility of the inhabitants, to come under the control of the municipal institution. With the protectorate, a new set of rules was implemented. At the urban level, the roadway regulation (règlement de voirie) of 1889 and the sanitary regulation of 1903 ended up giving body to a new vision of remediated, arranged, aligned, open and healthy urban space. This regulation coexisted with previous legal practices and uses until the end of 19th century. It is only at the dawn of the 20th century that the old uses disappear in favor of new rules and practices for the public road promotion. 1914 was a turning point in the urban management and the expansion of the capital. It also marked the primacy of the“ European city” .and the relegation of the old city to the status of a “district”. Keywords: Cleanliness, hygiene, uses, regulations, Tunis, public road, public space, municipal institutions. الملخص النظافة و الصحة و الفضاء العام في تونس من خلال الممارسات و التراتيب 1858- 1914 كان الحيز الحضري لمدينة تونس يعاني خلال النصف الثاني من القرن التاسع عشر من عديد المشاكل المتعلقة بالظروف الصحية و برزت في نفس الوقت إرادة لتجديده فأصدر المجلس البلدي(1858) ثم مجلس حفظ الصحة والنظافة العمومية (1873) تنظيمات تستند إلى مفهومي المصلحة العامة والمنفعة العامة كان من الصعب تطبيقها في أول الأمر. سيستغرق الأمر عقدين من الزمن حتى تغدو النظافة والظروف الصحية مسألة عمومية تحت سيطرة و مراقبة المِؤسسة البلدية بعد أن كانت شأنا خاصا بالسكان. تم وضع ترسانة تنظيمية جديدة في زمن الحماية. على المستوى العمراني، ساهمت تراتيب الطرقات لسنة 1889 و التراتيب الصحية لسنة1903 في بلورة رؤية جديدة لحيز حضري معقم و منضم و مصطف ومفتوح و صحي, أعتمدت هذه التنظيمات حتى نهاية القرن التاسع عشر في نفس الوقت الذي تواصل فيه العمل بالأعراف السابقة من ممارسات قانونية و عادات سكنية. في فجر القرن العشرين إختفت العادات القديمة لصالح القواعد و الممارسات الجديدة التي عززت الخيار العام فمثل بذلك عام 1914 نقطة تحول في توسع المدينة و إدارتها العمرانية كما أنه إقترن بإعطاء أولوية » للمدينة الأوروبية » مقابل إقصاء المدينة القديمة إلى مرتبة « حي » بمدينة تونس. الكلمات المفاتيح: النظافة، الظروف الصحية، الممارسات ، التنظيمات ، تونس ، الطرق العامة ، الأماكن العامة ، المؤسسات البلدية.
